Auctionly Terms of Use and Buyer/Seller Disclosure By creating an Auctionly account, you confirm that you have read, understood, and accepted these Terms of Use. These terms govern every listing, bid, purchase, message, and transaction made through Auctionly. 1. Marketplace role and item condition Auctionly is a marketplace platform. Sellers, not Auctionly, are responsible for the accuracy, legality, condition, authenticity, ownership, title, photos, descriptions, measurements, safety, and suitability of every item they post. Auctionly does not inspect, authenticate, grade, certify, guarantee, or endorse items and is not responsible for defects, damage, wear, missing parts, counterfeit goods, inaccurate descriptions, or any loss arising from an item or transaction. Buyers must review the listing carefully, ask questions before bidding, and make their own purchasing decision. 2. Accurate listings and prohibited conduct Sellers must provide truthful, complete, current information and must not use false advertising, misleading photos, manipulated descriptions, shill bidding, fake reviews, stolen images, counterfeit items, illegal items, or items they do not have the right to sell. Auctionly may investigate reports, request information, warn or suspend an account, remove a listing, cancel bids, or permanently ban a user when it believes these rules or applicable law may have been violated. 3. Bids, auctions, and final sale A bid is a binding offer. Do not bid unless you intend and are able to complete the purchase. When an auction ends, the winning bidder and seller are expected to complete the transaction. All transactions are final sale. Bids, purchases, and auction results generally cannot be cancelled, returned, reversed, or refunded through Auctionly. Any shipping, pickup, inspection, payment, taxes, or handoff arrangements are the responsibility of the buyer and seller unless Auctionly expressly states otherwise. 4. Auctionly fee Auctionly charges the seller a 10% marketplace fee calculated from the sold item’s final sale price. This fee is charged to and deducted from the seller’s proceeds; it is not charged to the bidder as a separate Auctionly fee. Sellers remain responsible for any applicable taxes, shipping costs, payment costs, and other expenses. 5. Reports, moderation, and seller warnings Users may report listings they believe contain fake information, false advertising, counterfeit goods, unsafe or illegal items, or materially misleading condition claims. Reports are reviewed at Auctionly’s discretion and are not proof that a violation occurred. Auctionly may warn the seller, request corrections, remove the listing, cancel an auction, suspend an account, or take other action without notice when appropriate. A seller warning or removal message is not a finding that Auctionly guarantees the reporter’s claim. 6. Accounts and communications You are responsible for your account, password, listings, bids, messages, and activity. You must be legally able to enter into transactions. Users may communicate with Auctionly administrators, but users may not use Auctionly to harass, threaten, defraud, spam, or improperly contact other users. 7. Limitation of liability To the maximum extent permitted by law, Auctionly and its owners, employees, contractors, and service providers are not liable for item condition, seller or buyer conduct, failed transactions, lost profits, indirect or consequential losses, fraud by another user, service interruptions, unauthorized access, or content posted by users. The platform is provided on an as-is and as-available basis. You use Auctionly at your own risk. 8. Changes and acceptance Auctionly may update these Terms of Use. Continued use after an update means you accept the revised terms. If you do not agree, do not create an account, bid, list, or use the marketplace. These terms do not limit any rights that cannot legally be waived and do not replace any mandatory consumer or privacy rights under applicable law.
